Information We Collect From You
In connection with your use of our products or services, we will obtain contact lists (including email addresses and other information for your subscribers) and content (including the content of your campaigns) that you provide to us in connection with such use. We acknowledge your ownership rights in such contact lists and content. We will never sell or rent your contact lists to anyone without your permission and will never use your contact lists or content for any purpose other than as described here.
If you decide to import contacts from other email accounts, we collect the username and password for the email account you wish to import your contacts from.
We obtain information that is provided by you on our public forums, including the Constant Contact Community and Constant Contact Marketplace. With your consent, we may also obtain and post testimonials or reviews for inclusion on our websites or elsewhere. Your posts may remain even after you suspend or cancel your account. Reviews and contributions to any of our public communities are considered public and non-confidential by us and are not treated as proprietary information or personal information covered by this privacy notice. To request removal of your personal information on our public forums or on the public portions of our websites, please visit the Privacy Center. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.
How We Use Your Information
We will only use the username and password for any email account you import any contacts from to enable you to import such contacts
Sharing of Information
If you are working with a partner, such as a Constant Contact Solution Provider, and would like that partner to have full access to your account, including the ability to send emails on your behalf, we will provide access to just that partner upon your request or consent.
Access to Personal Information
You can review and update your Constant Contact account information, including your organizational information and email address, by logging in and then clicking on the My Settings tab. Account information, such as your username and password, can be changed by logging in and then clicking on the My Account link at the top of page. The My Account page is also where you can manage product subscriptions and billing information, such as your credit card number. If you would like to suspend or cancel your account, you can do so by contacting customer support via the Constant Contact Help Center or by telephone at (866) 289-2101 if you are located in the U.S. or (781) 472-8140 if you are located outside of the U.S. If you would like to request that we no longer use your account data or obtain further information about or access to your personal information, please visit our Privacy Center. We will respond to your request for access within 30 days.
Refer a Friend
If you choose to use our referral service to tell a friend about our Services, we will ask you for your friend’s email address. We will automatically send your friend a one-time email inviting him or her to visit our website. We retain this information for the sole purpose of sending this one-time email and tracking the success of our referral program. Such referrals may not be permissible in all situations or in all jurisdictions. You acknowledge and agree that you are solely responsible for compliance with any applicable laws in this regard. Your friend may contact us at email@example.com to request that we remove this information from our database.
Constant Contact participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework (together, the “Frameworks”). Constant Contact is committed to subjecting all personal data received from European Union (“EU”) member countries and Switzerland, respectively, in reliance on each Privacy Shield Framework to the Framework’s applicable principles. Constant Contact is responsible for the processing of personal data it receives under each Privacy Shield Framework and subsequently transfers to a third party acting as an agent on its behalf. Constant Contact complies with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.
With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, Constant Contact is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Constant Contact may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Under certain conditions, more fully described on the Privacy Shield website, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.
